Bunium Terms & Conditions

1. Introduction

Bunium ("Bunium", "we", "us") is an interactive educational simulator for clinical reasoning. Bunium operates bunium.com and app.bunium.com.

These Terms & Conditions ("Terms") govern your access to and use of the Bunium website, web application, and any related services (together, the "Service").

By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

Bunium is an educational tool. It is not a medical device, it does not provide medical advice, diagnosis, or treatment, and it must not be used to make clinical decisions about real patients. Nothing produced by the Service — including AI-generated text, scoring, suggested investigations, or treatment plans — is a substitute for the judgment of a licensed clinician.

2. Eligibility

You must be at least 18 years old to use the Service. The Service is designed for adult learners and is not directed at children. If we discover that an account has been created by someone under 18, we will close the account.

The Service is intended for medical students, graduates preparing for licensing examinations (such as the USMLE), and qualified clinicians who want to practice clinical reasoning in a simulated environment. Use outside this audience is at your own risk.

You are responsible for ensuring that your use of the Service complies with the laws of the country or region from which you access it. We may, at our sole discretion, restrict or refuse access from any jurisdiction.

3. Early-Access Disclosure

Bunium is in active early-access development. New conditions, missions, algorithms, and features are added on a continuous basis, and existing ones may change without notice. Some components — including scoring rules, AI behaviors, and content depth — are incomplete and will evolve.

Because of the early-access nature of the Service, you should expect occasional bugs, downtime, content gaps, and rough edges. We work to fix issues quickly, but we cannot guarantee uninterrupted or error-free service during this period.

In these early phases the library of conditions, missions, and content may be limited, and individual areas may be shallow or unfinished. By creating an account, starting a trial, or subscribing during early access, you accept the Service as it exists today — your decision is based on its current state, not on any feature or content we may add later. We make no promise that any particular condition, feature, or depth of content will be available by a given date.

We actively welcome feedback. By submitting feedback, bug reports, or feature suggestions, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service, without obligation to you.

4. Accounts and Authentication

To use most of the Service you must create an account with a valid email address and a password. You must provide accurate information and keep it up to date. You are responsible for all activity that occurs under your account.

You are responsible for keeping your password confidential. You agree to notify us promptly if you suspect any unauthorized access to your account. We use industry-standard password hashing and email-based verification for sensitive operations.

Each account is for a single human user. You may not share your credentials, sell or transfer your account, or use the account of another person.

5. Acceptable Use

You may use the Service for personal, non-commercial educational purposes — to study, prepare for examinations, and practice clinical reasoning.

You agree not to:

  • use the Service to make clinical decisions about real patients;
  • scrape, mirror, copy, or otherwise extract Bunium content in bulk;
  • resell, sublicense, or redistribute access to the Service;
  • attempt to reverse-engineer the simulator, scoring engine, or AI prompts;
  • use the Service to harass, defame, or harm any person;
  • introduce malicious code or attempt to interfere with the security or availability of the Service;
  • circumvent rate limits, credit caps, or other technical restrictions;
  • use automated tools (bots, crawlers) to interact with the Service without our prior written consent.

The Service includes AI features, including conversations with simulated patients and attendings. AI output can be inaccurate, incomplete, or misleading. Treat all AI output as study material to be cross-checked, never as ground truth.

6. Subscription, Trial, and Refunds

When the paid Service is available, new subscribers may start with a free trial. The current trial length and any payment-method requirement are displayed at checkout before any charge.

The price, billing currency, billing cadence, and any founder discount in effect at the time you subscribe are displayed at checkout before any charge. Prices are exclusive of any applicable taxes and may vary by region.

Paid subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. If you started a trial without providing a payment method, we never charge you automatically — when the trial ends your access simply pauses until you choose to add a payment method, which you can do at any time. Payment processing is handled by Stripe on behalf of PENLIGHT AI INC; we do not store full card numbers.

Because a free trial lets you evaluate the Service before any charge, most users never need a refund. If you believe you are entitled to one — under any money-back guarantee we offer for your plan (the terms of which, if any, are shown at checkout) or under the mandatory consumer-protection law of your country — email contact@penlight.ai from the address on your account and we will review the request. We do not require you to justify a request that is covered by a guarantee we have offered, and we will not unreasonably withhold a refund the law entitles you to. We may decline requests we reasonably believe to be abusive (for example, repeat refund-then-resubscribe cycles).

We may change subscription prices in the future. Any price change will be announced at least thirty (30) days in advance and will not affect a billing period you have already paid for. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

7. Intellectual Property

All content, code, designs, illustrations, algorithms, case templates, and scoring rules that make up the Service are owned by Bunium or its licensors and are protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for the purposes described in these Terms.

Any feedback, suggestions, bug reports, ideas, or other communications you send to us about the Service are licensed to us on a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable basis. We may use them to improve the Service without any obligation to you.

You retain ownership of any content you create that is genuinely your own (for example, personal notes you type into the app, if such a feature is enabled). You grant us the limited licenses necessary to store, display, and process that content so we can operate the Service for you.

"Bunium" and the Bunium logo are trademarks of Bunium. You may not use them without our prior written permission, except for fair-reference purposes consistent with these Terms.

8. Disclaimer of Warranties and Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise — including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content or AI output is accurate.

We explicitly do not warrant that the educational content reflects the most current medical evidence, local guidelines, or your specific examination's scoring rubric. Bunium is not a substitute for textbooks, attending physicians, or licensed medical training.

To the maximum extent permitted by applicable law, our total cumulative liability arising out of or relating to the Service, in contract, tort, or otherwise, will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, and (b) one hundred US dollars (US$100).

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including loss of profits, loss of data, loss of educational outcomes, or any damages arising from clinical decisions you make based on the Service.

Nothing in these Terms is intended to exclude or limit any rights you have under mandatory applicable consumer-protection law that cannot be excluded or limited by contract.

9. Termination and Account Deletion

You may stop using the Service and delete your account at any time from your account settings or by contacting support. Deletion is processed as described in our Privacy Policy.

We may suspend or terminate your access to the Service if you breach these Terms, if your use of the Service exposes us or other users to risk, or if continued provision becomes impractical (for example, on shutdown of the Service). Where reasonable, we will give you advance notice.

On termination, your right to use the Service ends. We will retain or delete your data as described in the Privacy Policy and as required by applicable law. Clauses that by their nature should survive termination (intellectual property, disclaimers, liability limits, dispute resolution) will continue to apply.

10. Changes to These Terms

Each version of these Terms carries a version string and an effective date. The current version is shown at the top of this document. Older versions are archived and can be requested by contacting us.

When we publish a materially new version, we will (a) update the version string and effective date, and (b) require you to acknowledge the new version on your next sign-in via a checkbox. Continued use of the Service after the effective date of a new version constitutes acceptance of that version.

These Terms are governed by the laws of the State of Delaware, USA, the jurisdiction in which PENLIGHT AI INC — the legal entity through which Bunium accepts payments — is incorporated, without regard to its conflict-of-laws principles. Mandatory consumer-protection laws of your country of residence are preserved where they cannot be contracted away.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
